The short version: FoodCheat estimates calories from photos. Estimates are approximate and sometimes wrong, so don't treat them as medical advice. Pro is an auto-renewing subscription billed by Apple, and you cancel it in your Apple ID settings. Use the app like a person, not a script.
These Terms of Service ("Terms") are an agreement between you and FoodCheat LLC ("FoodCheat," "we," "us"), a Texas limited liability company. They govern your use of the FoodCheat mobile application and related services (the "Service"). By downloading, creating an account, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who can use FoodCheat
You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may only use the Service with the involvement of a parent or guardian. You agree that the information you provide when creating an account is accurate.
2. What FoodCheat is, and what it is not
FoodCheat uses artificial intelligence to estimate the calorie and nutrition content of food from photographs, label scans, and descriptions you provide.
Estimates are approximate. Photo-based nutrition estimation is inherently imprecise. Portion sizes, preparation methods, oils, sauces, and hidden ingredients cannot be determined reliably from an image. Numbers shown in the app are estimates, not measurements, and may be materially wrong.
FoodCheat is not medical advice. The Service is for general informational and self-tracking purposes only. It is not a medical device and does not provide medical, nutritional, dietary, or health advice, diagnosis, or treatment. Do not use the Service as a substitute for consulting a physician, registered dietitian, or other qualified professional. Never disregard or delay professional advice because of something you saw in the app. If you have or suspect a medical condition, including any eating disorder, talk to a healthcare provider.
You are solely responsible for decisions you make based on information from the Service.
3. Your account
You are responsible for your account credentials and for activity under your account. Tell us promptly at support@foodcheat.app if you believe your account has been accessed without your permission.
4. Your content
You keep ownership of the photos, descriptions, and other content you submit ("Your Content"). You grant FoodCheat a limited, non-exclusive, worldwide license to host, store, process, and transmit Your Content solely to operate and improve the Service, including sending images and text to third-party AI providers for analysis.
You represent that you have the right to submit Your Content and that it does not violate the law or anyone else's rights.
5. Free tier, Pro subscriptions, and billing
Free tier. Free accounts include a limited number of food scans per day. Additional scans may be made available in exchange for viewing an advertisement, at our discretion and subject to ad availability.
Pro subscriptions. Pro is offered as an auto-renewing subscription purchased through the Apple App Store. Pricing, billing period, and renewal terms are disclosed at the point of purchase.
- Payment is charged to your Apple ID account at confirmation of purchase.
- Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
- You manage and cancel your subscription in your Apple ID account settings. We cannot cancel it for you.
- Refunds are handled by Apple under its policies. We do not control and generally cannot issue refunds for App Store purchases.
Fair use. Pro removes the everyday scan limits, subject to fair use. The Service is intended for personal food logging. We may apply rate limits and daily caps, and we may suspend, limit, or terminate accounts that show automated, scripted, abusive, or otherwise abnormal activity, or use that materially exceeds normal personal use.
Price changes. We may change pricing for future billing periods. Changes will not affect a period you have already paid for, and Apple will notify you as required.
6. Advertising
The Service may show advertisements, including optional rewarded video ads that unlock additional scans. Ads are provided by third parties, including Google AdMob, and are subject to their own terms and privacy practices. Ad availability is not guaranteed.
7. Acceptable use
You agree not to:
- use bots, scripts, scrapers, or automated means to access the Service;
- attempt to circumvent scan limits, rate limits, paywalls, or ad requirements;
- reverse engineer, decompile, or attempt to extract source code or model prompts;
- resell, sublicense, or commercially exploit the Service or its outputs;
- upload unlawful, infringing, or harmful content;
- interfere with or place unreasonable load on our infrastructure or third-party providers;
- use the Service in violation of any applicable law.
8. Third-party services
The Service relies on third parties, including Apple, Google AdMob, FatSecret, and AI model providers. Nutrition data provided by FatSecret is used under its terms and is attributed where required. We do not control these providers and are not responsible for their services, data accuracy, or availability.
9. Availability and changes
We may modify, suspend, or discontinue any part of the Service at any time, including features, limits, and pricing tiers. We do not guarantee uninterrupted or error-free operation.
10. Suspension and termination
We may suspend or terminate your access at any time if you violate these Terms, if we suspect abuse or fraud, or if required by law. You may stop using the Service at any time and may delete your account from within the app. Terminating your account does not automatically cancel an active App Store subscription; cancel that through Apple.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT NUTRITION ESTIMATES ARE ACCURATE, COMPLETE, OR SUITABLE FOR ANY PARTICULAR PURPOSE.
Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOODCHEAT LLC AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (B) FIFTY U.S. DOLLARS.
13. Indemnification
You agree to indemnify and hold harmless FoodCheat LLC from any claims, damages, losses, and expenses, including reasonable attorneys' fees, arising from your use of the Service or your violation of these Terms.
14. Changes to these Terms
We may update these Terms. If changes are material, we will provide notice in the app or by email. Continued use after changes take effect means you accept the updated Terms.
15. Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in Collin County, Texas, and you consent to their jurisdiction.
16. Apple
These Terms are between you and FoodCheat LLC, not Apple. Apple is not responsible for the Service or its content and has no obligation to provide support or maintenance. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
